Policies and Disclaimer

 
At Museum Oil Paintings, we seek to provide the safest delivery of art to our clients.  All works are packaged to our exceptional standards. Museum Oil Paintings has extensive experience in the handling of both valuable and delicate works of art.  Due to the irreplaceable nature of most items we offer, all works are shipped with insurance and require a signature as proof of delivery.
 
In the unlikely event that a piece of work incurs any sort of damage in transit, it is important that the client informs Museum Oil Paintings within 24 hours of signing off on the piece.  To protect our clients, a date stamped photograph of the artwork must be taken and submitted to IGE as evidence of damage.
 
Please inquire about Museum Oil Paintings’s money back guarantee service.  This enables the client to make a purchase, hang the piece for 30 days and if not absolutely satisfied, Museum Oil Paintings will organize the collection of the piece and refund 100% of your purchase price.  The painting must be photographed by the client and submitted to Museum Oil Paintings.  This enables us to ensure the condition of the work prior to the return shipment.  This is one of our most important policies and a great part of our customer relation success.
 
Affiliates are provided with a login and password that allows them to track the movement of their referred clients. You will be able to see what purchases have been made as a result of your advertising, as well as the commission you will receive.
 
Copyrighted Works
 
Clients commissioning works from photographs should have the necessary copyright or permission to utilize the photograph.  The copyright is usually retained by the person who has taken the photograph and is thus the only person whom may legally commission a painting from said image.  Clients are responsible and liable for the images.  Uploaded photographs must be submitted by the client with permission or copyright privileges.  Once a photograph is submitted to Museum Oil Paintings, it is assumed that the permission to reproduce the image has been given by the client.  The client retains the original copyright to the image and the reproduction.  Client’s have the right to use their image and the reproduction.  They agree to all terms set out by Museum Oil Paintings.
 
Museum Oil Paintings respects the rights of original artists.  A masterpiece may be reproduced once it becomes part of the public domain.  The original artist and their estate hold the copyright to the work until 70 years has passed after their death.  Artworks that have not become part of the public domain require permission from the estate to reproduce.  Museum Oil Paintings is committed to respecting the rights of the original artist and will never accept a commissioned work that is subject to copyright infringement.

Client information will be used to respond directly related to your inquiry.  Client information will never be shared outside of our organization, except at the client’s consent.  This includes shipping our client’s purchases.  Information requested on your order form, including your name, shipping address, and financial information, will be used solely for billing and filling orders.  We require a client’s shipping information to forward purchases.  Shipping information is provided to our studio artists for direct shipment of client purchases.   In the event an order is unable to be fulfilled or there are issues in the processing, we will use your provided information to contact you.  Our client’s are notified of any issues throughout the steps of the ordering, drafting and shipping.
 
Museum Oil Paintings is committed to the protection of our client’s financial security.  Client information and right to confidentiality are protected both online and offline.  All sensitive information is encrypted and securely transferred directly to the ordering department.  Client credit card information is not accessible within our company while using PayPal methods of payment.  PayPal acts an intermediary in payments, processing both credit cards and payments linked to a bank account.  When paying with PayPal, the client will provide only their PayPal email address to Museum Oil Paintings.  The payment is then made by PayPal, without the transfer of client financial information.  This method prevents third parties from obtaining access to your financial information.  Please see PayPal’s policies for more information. 
 
Encryption protects your personal information online, but we take further precautions to ensure your security is maintained offline.  Your information will be accessed only by authorized associates for specific purposes, including billing and quality assurance.  Associates require direct departmental permission and are only able to access your information under supervision.  Our servers containing sensitive information are kept in a secure location.  The servers are password protected.  Any alternations, inquiries into or access of your information is strictly monitored and will be assessed on a regular basis by our Client Security and Confidentiality Department.

As reproductions, the oil paintings will differ in details from the artist’s original work.  These differences signify the unique nature of an oil painting, as no painting can be an exact replica of another.  Differences may include, but are not limited to: length of brushstrokes, angle of brushstrokes, size of the canvas and toning of pigments. 
 
Museum Oil Paintings is committed to creating museum quality reproductions.  Our artists respect the depth, the intricacy of the composition and the elements of design present in the original work, creating a reproduction that is unmatched in any other studio.  We guarantee our client’s full satisfaction of their commissioned oil painting.
 
Museum Oil Paintings respects the original artists’ rights and will not infringe upon any copyrights.  Requests for commissioned work that violate these rights will not be accepted, to protect the integrity of our studio and our clients.  When commissioned works are accepted by Museum Oil Paintings, it is assumed that the image is the client’s property.  The client is assumed to have rights to reproduce the image and/or painting, or has written consent to reproduce the image.  In the event that the image submitted by the client for a commissioned portrait or painting infringes on any rights, the client is held fully liable.
